The Munich Local Division of the European Union’s Unified Patent Court has granted Oxford Nanopore Technologies a preliminary injunction against sales of MGI Tech’s nanopore sequencers.
Under the order, MGI must refrain from making, offering, marketing, using, importing, storing or supplying the affected sequencing systems and related flow cells. The injunction applies in Denmark, France, Germany, the Netherlands, Liechtenstein, Switzerland, the UK, and Ireland. In Ireland, the injunction is limited to use of the instrument with a flow cell.
The preliminary injunction is effective immediately and is enforceable pending appeal. In a Sept. 16 statement, MGI Tech said that it “respectfully but firmly” disagrees with the decision and that it will pursue an appeal.
Oxford Nanopore said it will pursue a permanent injunction, with a trial hearing scheduled for October 2027.
